The Consumer Product Safety Commission (CPSC) has voted to extend the stay of enforcement on section 102(a) of the Consumer Product Safety Improvement Act (CPSIA). Indepenting testing and certification of lead content for certain classes of children’s products will not be required until 2012.
In a four-to-one vote, the CPSC voted to extend the current stay of enforcement until December 31, 2011. As reported last week, the CPSC recommended the stay be extended until September 14, 2011. “Although the recommendation before us was to extend the stay until the middle of September, this would have imposed an expensive testing burden on small manufacturers during one of their busiest seasons,” CPSC Commissioner Nancy Nord wrote on her website.
Tuesday’s vote marks the sixth delay on part of the CPSIA regulation. Had the commission voted against the extension, enforcment would have started next week, on February 11. Forbes has further details on the vote and its impact on small businesses.
