Dynamic Drinkware, Oshkosh, Wis., took what the company called a “huge step” in its federal court case against National Graphics Inc., North Branford, Conn.
According to Plastics Today, Judge William C. Griesbach of the U.S. District Court for the Eastern District of Wisconsin granted Dynamic Drinkware’s motion for summary judgment that it did not infringe on three U.S. patents relating to methods of creating lenticular images.
The court denied both parties’ motions with respects to another U.S. patent (referred to as the ‘196 patent).
“We are absolutely confident that facts presented at trial will clearly demonstrate that Dynamic’s proprietary process for molding lenticular cups does not infringe the ‘196 patent and that the ‘196 patent is invalid,” Barry Johnson, CEO of Dynamic Drinkware, told Plastics Today. “The facts are equally clear regarding the patents related to the process for improving the quality of lenticular imaging.”
